The specific scope, deliverables, and timelines for each project will be outlined in a separate written Service Agreement or Proposal, which will work in tandem with these terms.
All services are provided with reasonable care and skill. However, digital marketing results (such as search ranking increases, traffic volumes, or conversion rates) depend heavily on third-party platform algorithms (Google, Facebook, Instagram, etc.), which change frequently. We cannot guarantee specific rankings, positions, or sales metrics as a direct result of our campaigns.
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
Upon final payment of all outstanding invoices for a specific development project, full ownership of code and media assets designed specifically for the client (e.g., custom website files, graphic designs, edited video files) will transfer to the client, excluding proprietary frameworks or third-party assets utilized under license.

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our marketing services, even if we have been advised of the possibility of such damages.
Our maximum liability for any dispute arising out of or related to these terms or our services shall be limited to the total fees paid by the client for the specific service in dispute during the three (3) months prior to the claim.
These Terms & Conditions and your use of the Site are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in Kolkata, West Bengal, India.
These Terms & Conditions shall remain in full force and effect while you use the Site. Either party may terminate ongoing retainer services by providing thirty (30) days written notice. In the event of termination, the client is responsible for paying all outstanding invoices for work completed up to the effective termination date.
